1.5 For the purposes of this Notice, the Oregon Tool entity which website you visit or which contracts with you acts as the data controller for their Personal Data. As a data controller, that Oregon Tool entity is responsible for ensuring that the processing of Personal Data complies with applicable data protection law, and specifically with the General Data Protection Regulation. In addition, Oregon Tool Inc. may also act as data controller for certain processing activities in relation to your Personal Data on a group-wide level.

3. Who does Oregon Tool share your Personal Data with?

(a) to our group companies for purposes consistent with this Notice. We take precautions to allow access to Personal Data only to those staff members who have a legitimate business need for access and with a contractual prohibition of using the Personal Data for any other purpose.

(b) to our third-party vendors, services providers and partners who provide data processing services to us, or who otherwise process Personal Data for purposes that are described in this Notice or notified to you when we collect your Personal Data. This may include disclosures to third party vendors and other service providers we use in connection with the services they provide to us, including to support us in areas such as IT platform management or support services, infrastructure and application services, marketing, data analytics;

(c) to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;

4. How we protect your privacy

4.1 We will process Personal Data in accordance with this Notice, as follows:

(a) Fairness: We will process Personal Data fairly. This means that we are transparent about how we process Personal Data and that we will process it in accordance with applicable law.

(c) Proportionality: We will process Personal Data in a way that is proportionate to the purposes which the processing is intended to achieve.

(d) Data accuracy: We take appropriate measures to ensure that the Personal Data that we hold is accurate, complete and, where necessary, kept up to date. However, it is also your responsibility to ensure that your Personal Data is kept as accurate, complete and current as possible by informing Oregon Tool of any changes or errors. (e) Data security: We use appropriate technical and organisational measures to protect the Personal Data that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your Personal Data. Specific measures we use include encryption of transmission of confidential information (e.g., login credentials or information submitted from within the Website) using secure socket layer technology (SSL).

(f) Data processors: We may engage third parties to process Personal Data for and on behalf of Oregon Tool. We require such data processors to process Personal Data and act strictly on our instructions and to take appropriate steps to ensure that Personal Data remains protected.

(g) International data transfers: Your Personal Data may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country (and, in some cases, may not be as protective).

Specifically, our servers are located in European Union and in the US, and our group companies and third-party service providers and partners operate around the world. This means that when we collect your Personal Data we may process it in any of these countries.

However, we have taken appropriate safeguards to require that your Personal Data will remain protected in accordance with this Notice. These include implementing Binding Corporate Rules for transfers of Personal Data between our group companies, which require all group companies to protect Personal Data they process from the EEA in accordance with European Union data protection law. When transferring personal data to our third-party vendors, suppliers, service providers and other third parties located outside the EU/EEA, we rely on the EU’s Standard Contractual Clause. Our Standard Contractual Clauses can be provided on request.

(h) Data Retention: We retain Personal Data we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

When we have no ongoing legitimate business need to process your Personal Data, we will either delete or anonymise it or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible.

(d) You have the right to opt-out of marketing communications we send you at any time. We do not accept any responsibility or liability for the privacy practices of such third-party Websites and your use of such Websites is at your own risk.

8. For California Residents

8.1 This notice is provided to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice. As used in this section, “personal information” means information that meets the definition of “personal information” as set forth in the CCPA and is not otherwise excluded from the scope of the CCPA (e.g., publicly available information).

8.2 A California Resident’s Rights Under the CCPA

8.2.2 Right to deletion

8.2.3 Right to opt out of sale or sharing
Subject to certain business and legal exceptions, including those noted above, you may request that we stop selling or sharing your personal information for cross-context behavioral advertising. Notwithstanding the foregoing, we do not sell or share your personal information for cross-context behavioral advertising.

8.2.4 Right to correct
We will use commercially reasonable efforts to comply with your request to correct any inaccurate personal information.

8.2.5 Right to limit the use and disclosure of Sensitive Personal Information
Subject to certain business and legal exceptions, including those noted above, you may request that we limit the use and disclosure of sensitive personal information, as that term is defined under the CCPA (e.g., social security number, driver’s license number, passport number, account log-in information, and a precise geolocation).

8.2.6 Right to data portability
At your request, and subject to certain exceptions, we will provide you free of charge with any of your personal information that we hold, and will provide it in a structured, commonly used and machine-readable format.

8.2.7 Right to nondiscrimination
You are entitled to exercise the rights described above free from discriminatory treatment prohibited by the CCPA.
